WIDGET AVAILABILITY AND BETA NOTICE
Please note that GenZave is currently in a beta version, meaning that certain features are in development and may be updated or expanded over time. Not all widgets are currently available on the Android version of the application. Only the widget displaying the percentage is accessible for Android users; all other widget functionalities and images displayed in the app preview are exclusively available for iOS users. We are working to extend these features to Android as soon as possible.
In the future, we may introduce additional functionalities, including potential subscription options, in-app purchases, or advertisements to support the application.


AGREEMENT TO LEGAL TERMS
These Terms and Conditions ("Legal Terms") constitute a legally binding agreement between you, the user (“you”), and BLANC Mathieu, doing business as MBsolution ("Company," "we," "us," or "our"). By accessing or using "GenZave" (collectively the "Services"), you acknowledge that you have read, understood, and agree to be bound by these Legal Terms. If you do not agree, you are prohibited from using the Services and must discontinue use immediately.

1. OUR SERVICES
GenZave is a mobile application developed to improve productivity and happiness through technology. With a core focus on user privacy, GenZave ensures minimal data collection and local data storage. All user data remains securely stored on their devices, protected by advanced encryption standards. The app complies with GDPR and CCPA, and personal information is not sold to third parties.
Currently in beta, GenZave provides limited features with planned updates and improvements over time. Additional functionalities, such as new widgets, expanded Android support, and potential in-app purchases or ads, may be added in future updates.


2. INTELLECTUAL PROPERTY RIGHTS
The Company owns all intellectual property rights for the content and materials provided on the Services. Users are granted a limited, revocable, non-exclusive license for personal use only. Any unauthorized use, reproduction, or distribution of the Company’s content is strictly prohibited.


3. USER REPRESENTATIONS
By using the Services, you confirm that:

• You have the legal capacity to agree to these Legal Terms.

• You are at least 13 years of age.

• You will not use the Services for unauthorized or illegal purposes.
  
   

4. SOFTWARE
Any software provided within the Services is licensed for limited, personal use. Users may not reproduce, modify, or distribute the software, except as expressly authorized.


5. PROHIBITED ACTIVITIES
Users agree not to engage in any activities that compromise the Services' integrity, security, or legal compliance. This includes, but is not limited to, unauthorized data collection, spamming, impersonation, unauthorized distribution of premium content, and any form of unauthorized access or data manipulation.


6. USER-GENERATED CONTRIBUTIONS
Any content submitted or posted by users must not infringe upon third-party rights, be obscene, misleading, or illegal. Contributions are non-confidential, and the Company reserves the right to remove or moderate any content that violates these standards.


7. PRIVACY POLICY
Our Privacy Policy, available within the Services, explains our data collection, use, and processing practices, which are aligned with GDPR and CCPA. By using the Services, you consent to data processing in compliance with these laws.


8. TERM AND TERMINATION
These Legal Terms remain in effect as long as you use the Services. We reserve the right, at our discretion, to restrict or terminate access to the Services at any time without notice for any breach of these Legal Terms or applicable law. In case of termination, you may not create a new account using similar information.


9. MODIFICATIONS AND INTERRUPTIONS
We reserve the right to modify, suspend, or remove any part of the Services at any time. We do not guarantee continuous availability of the Services and are not liable for service interruptions, updates, or technical issues that may limit access.


10. GOVERNING LAW
These Legal Terms are governed by French law. Any disputes arising from these Legal Terms shall be subject to the jurisdiction of the courts in Alsace, France, except as otherwise required by applicable EU consumer law.


11. DISPUTE RESOLUTION
Informal Negotiations: Before proceeding with arbitration, both parties agree to attempt to resolve any dispute informally for at least 30 days.
Binding Arbitration: Any unresolved disputes will be submitted to binding arbitration under the European Centre of Arbitration’s rules. The arbitration will be held in Mulhouse, France, and the proceedings will be conducted in French. Arbitration will be limited to individual disputes only, with no class action or group proceedings permitted.


12. CORRECTIONS
We reserve the right to correct any errors or omissions in the information provided by the Services, including product descriptions, prices, and availability, at any time without prior notice.


13. DISCLAIMER
The Services are provided "AS IS" and "AS AVAILABLE". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the accuracy of information or the continuous availability of the Services. Since the application is currently free and in beta, we reserve the right to make changes to the Terms should any paid features or advertisements be added in the future.


14. LIMITATIONS OF LIABILITY
Under no circumstances will we be liable for any indirect, special, exemplary, incidental, or consequential damages resulting from your use of the Services, even if we have been advised of the possibility of such damages. Given that the application is free and in beta, our liability is limited to normal usage within the bounds of these Terms.


15. INDEMNIFICATION
You agree to defend, indemnify, and hold the company, including its subsidiaries, agents, and employees, harmless from any claims, losses, or demands resulting from your use of the Services or any violation of these Legal Terms.


16. USER DATA
We will maintain certain data transmitted to the Services to manage performance. However, we are not liable for the loss or corruption of such data, and you waive any right to pursue action against us for any data loss.


17. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You agree to receive electronic communications and consent to the use of electronic signatures, contracts, orders, and records, granting them the same legal effect as physical documents.


18. CALIFORNIA USERS AND RESIDENTS
If you reside in California and your complaint is not satisfactorily resolved, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs.


19. MISCELLANEOUS
These Legal Terms constitute the entire agreement between you and us concerning your use of the Services. If any provision is deemed unlawful or unenforceable, it will be severable from the other provisions, which will remain in effect. No partnership, employment, or agency relationship is created by these Legal Terms.
